| metadata.dc.description.resumo: | No presente artigo tem-se como objetivo analisar a jurisprudência do Supremo Tribunal Federal em relação à aplicação das penalidades por litigância de má-fé e compará-la com as inovações sobre o tema trazidas pelo Código de Processo Civil de 2015. Para tanto, foi pressuposto o arcabouço teórico da Teoria Estruturante do Direito para orientar a reflexão sob o comportamento jurisprudencial do STF colhido de seu sítio eletrônico. A estruturação desse comportamento jurisprudencial levou à conclusão que a aplicação das penalidades por litigância de má-fé é voltada à efetividade do dever de contribuir com a justiça, não necessariamente da forma como se apresenta expressamente na legislação infraconstitucional. |
| Abstract: | This paper aims to analyse the brazilian Federal Supreme Court’s decisions in relation to the enforcement of penalties against bad faith behavior on the judicial process and compare those decisions with the innovations introduced by the Civil Procedure Code, enacted in 2015. For this purpose, it was used theoretical postulates from Structuring Legal Theory in order to guide the study of the Federal Supreme Court’s behavior obtained from the Cout’s web site. The structuring of that behavior led to the conclusion that enforcement of bad faith penalties focuses on effectiveness of the duty to contribute to the justice, not necessarily focuses on the legal basis. |
