dc.description.abstract: The premise of this Article is the transposition of the fundamental duty’s concept to an international context. It approaches the fundamental duty of environmental protection, specifically related to the existence of an international duty from vessels to recycle their plastic waste. From a dialectic approach, it analyses the ships’ duties stipulated in international treaties such as London Convention of 1972, London Protocol of 1996 and MARPOL 73/78. The article innovates since discuss that the fulfillment of international duties by vessels are insufficient, because they still contribute to the marine pollution by plastics. dc.description.resumoO artigo tem como premissa a possibilidade de transposição do conceito de dever fundamental para o âmbito internacional. Aborda-se o dever fundamental de proteção ambiental, especificamente quanto à existência de um dever internacional dos navios de reciclarem os resíduos plásticos produzidos na embarcação. A partir de uma abordagem dialética, são analisados os deveres dos navios impostos por tratados internacionais como a Convenção de Londres de 1972, o Protocolo de Londres de 1996 e a MARPOL 73/78. O artigo inova ao discutir que o cumprimento dos deveres internacionais pelos navios é insuficiente, pois ainda assim contribuem com a poluição marinha por plásticos.
