Os organismos geneticamente editados x organismos geneticamente modificados: uma análise a partir do princípio da precaução

Abstract

The article analyzes the interference of genetically edited foods (OGE) through the use of the CRISPR technique in the realization of the Fundamental Right to Health, from the perspective of bioethics, the precautionary principle and the risk society. In addition to checking whether the current legislation that disciplines genetically modified organisms (GMOs) is compatible and sufficient to discipline these new organisms. Method: From a dialectic-based analytical perspective and through a descriptive exploratory study, the differences between OGE and GMO, in relation to food production and the possible consequences to human health, resulting from these genetic modifications were analyzed. Law No. 11,105 / 05 (Biosafety Law) was also analyzed in order to understand whether it needs to be improved, as well as studying how the topic is treated in Europe from a legislative perspective, from the studies of “Association for Responsible Research and Innovation in Genome Editing” (ARRIGE), for comparative purposes with Brazilian legislation
