A necessidade de regulamentação da remição da pena pela leitura como efetivação do direito à educação

Abstract

In view of the recommendation of the National Council of Justice n ° 44/2013, there is a need to reflect on the effects of the remission of the penalty for reading within the prison system in recent years, having as a central point the lack of regulation of this recommendation and the consequences of this deprivation of the right to education. The present research aims to present and analyze the effects of the regulation of the reading remission project based on the results of an extension project called “Ler Liberta” Project - Law Faculty of Vitória, held at the State Penitentiary of Vila Velha I (PEVV 1), in Espírito Santo. At first, the entire course of legislation was presented regarding the remission of the sentence in Brazil and how it influences the function of the sentence. Then, the present relationship between Law and Literature was presented in the project of remission of the penalty for reading. In the end, the benefits of a possible regulation of Recommendation No. 44 were presented and how this measure can contribute to the social reintegration of the most inmates.
