O dever de doar sangue: averiguação de sua fundamentalidade e análise das atuais políticas públicas de hemoterapia

Abstract

The main focus of this study is to address a crucial issue with regard to public health in Brazil: blood donation and the effectiveness of current public policies implemented by the Ministry of Health linked to it. This question is analyzed in the light of the Theory of Fundamental Duties and in the perspective of solidarity, that is, it is discussed whether blood donation (voluntary) when analyzed from the perspective of the components of the Theory of Fundamental Duties (which are explained in a first moment ) can be considered a fundamental duty of the individual before the community, aiming at the realization of fundamental rights such as health. This study is carried out through extensive bibliographic research and analysis of documents, using a juridical-sociological aspect and the deductive research method (we start from broad and generic findings about the Fundamental Duties, to then particularize even the blood donation as a fundamental duty of the individual).
