O fracasso do judiciário quanto as demandas sobre bullying: uma análise quantitativa

Abstract

It seeks to explore and understand the actions of the judiciary in the demands on bullying, according to the published decisions. The method used to collect the data included a search for sentences published in the year 2018 which contained in their text the vernacular "bullying". We opted for the research in the São Paulo judiciary due to the ease of the 1st grade computerized demands. First, they separated those that came from a process that had as cause to request the systematic intimidases. Afterwards, the decisions were filtered between unreasonable, proceeds and partially proceeds. The victims, the applicants, the aggressors, the defendants, the location of the factual case, the institutions of education in the situation and the values ​​involved were raised. From there, it was possible to glimpse the following questions: 1- There is a mirroring between who is victim and who is applicant; 2- A huge disparity between whoever attacks and who is required; 3. The high incidence of the school as a party involved in the issue of systematic bullying
