A influência da mídia nos processos de competência do tribunal do júri: uma análise à luz do princípio constitucional da presunção de inocência

Abstract

This paper aims to analyze the influence of the media in the judgments given by the Jury, especially in relation to cases widely publicized in the media, in light of the principle of presumption of innocence. For this, through a qualitative research, based on a bibliographical study, initially seeks to analyze the history of the institute of the People's Court in Brazil, highlighting its constitutional principles. Next, we study the freedom of the press and the right to information, also constitutionally guaranteed, along with the importance of the media to society. Finally, the influence of the media in the Sentencing Council is explored in the face of the presumption of innocence, including through three emblematic cases, so that the negative influence that the media's performance in the jury value judgment is addressed , and he can judge the freedom of the accused solely on the basis of facts derived from the information and approach of the information vehicles and not from the facts brought to justice, considering the system of intimate conviction applied in the plenary session of the Jury.
