| metadata.dc.description.resumo: | O estudo do tema acerca da mudança legislativa, no que tange a ocorrência de homicídio culposo na direção de veículo automotor sob influência de álcool, envolve questionamentos em relação aos limites da culpa consciente e do dolo eventual e a finalidade e consequências dessa mudança no âmbito social. Isto posto, vale salientar, que após 21 anos da promulgação da Lei 9.503/1997, na parte que trata do crime de homicídios culposos provocados por condutores sob a influência de álcool ou de outra substância psicoativa que cause dependência, a pena mínima da infração foi elevada para cinco anos, artigo 302, parágrafo 3° da referida lei, aproximando-se da pena mínima do homicídio doloso. |
| Abstract: | The study of the topic of legislative change, regarding the occurrence of guilty homicide in the direction of a motor vehicle under the influence of alcohol, involves questions regarding the limits of conscious guilt and eventual deceit and the purpose and consequences of this change in the social sphere . After 21 years of the promulgation of Law 9,503 / 1997, in the part that deals with the crime of guilty homicides caused by drivers under the influence of alcohol or another addictive psychoactive substance, the minimum penalty of the infraction was raised to five years, article 302, paragraph 3 of said law, approaching the minimum penalty of willful homicide. |
