Abstract

The present article considers male domination that legitimates and perpetuates the submission of women, and this scenario is also perceived in the division of labor. Although capitalism appropriates this structure by exploiting female labor, it reserves positive discrimination because it is the only one responsible for the family sphere: maternity leave. However, it is demonstrated that this measure reinforces the social division of gender, by assigning to women only the task of creation and responsibility with the children, even those who work in the public space. Thus, the temporal equivalence of the right of paternity leave to that of maternity leave is seen as a way of making the exercise of the right to paternity possible for men and the joint care of the children and, at the same time, women's freedom of choice for the exercise of other attributions, not only those that are imposed by the social order.
