dc.description.abstractIt identifies the aspects involved in the concept of environment in the Brazilian Federal Constitution of 1988. It investigates whether the current cultural environment constitutional text involves intangible cultural goods. Discusses the concept of fundamental duty. It analyzes if there is a fundamental duty on the part of the collective of preservation of the cultural environment of the formative groups of the Brazilian society. It does a study of the case of Pomeranians in the Municipality of Santa Maria do Jetibá, in the state of Espírito Santo. It discusses whether harmonization of fundamental duty is possible in relation to the constitutional principle of freedom.pt_BR

Investiga se o meio ambiente cultural atual texto constitucional envolve os bens culturais imateriais. Discute o conceito de dever fundamental. Analisa se há um dever fundamental por parte da coletividade de preservação do meio ambiente cultural dos grupos formadores da sociedade brasileira. Faz um estudo do caso dos pomeranos no Município de Santa Maria do Jetibá, no estado do Espírito Santo.
