Dever fundamental de preservação do meio ambiente cultural e a liberdade

Abstract

It identifies the aspects involved in the concept of environment in the Brazilian Federal Constitution of 1988. It investigates whether the current cultural environment constitutional text involves intangible cultural goods. Discusses the concept of fundamental duty. It analyzes if there is a fundamental duty on the part of the collective of preservation of the cultural environment of the formative groups of the Brazilian society. It does a study of the case of Pomeranians in the Municipality of Santa Maria do Jetibá, in the state of Espírito Santo. It discusses whether harmonization of fundamental duty is possible in relation to the constitutional principle of freedom.
