Para tanto, foi demonstrada a evolução do instituto nas Constituições brasileiras, a fim de expor a intenção do legislador atual em consolidá-lo.Entretanto, em certos casos, a sociedade capitalista parece conspirar contra a função social da propriedade, ao atribuir a esta uma visão absoluta já superada com o advento do Estado Democrático de Direito. |
| Abstract: | This research analyzed the relationship between the social function of the property and the community of Pinheirinho, in order to emphasize its need for application. In order to do so, it was demonstrated the evolution of the institute in the Brazilian Constitutions, in order to expose the intention of the current legislator to consolidate it. However, in certain cases, capitalist society seems to conspire against the social function of property, absolute vision already overcome with the advent of the Democratic State of Law. |
