metadata.dc.description.resumo: O presente trabalho visa criticar a justiça penal que segue a lógica punitiva e que vigora em toda a sociedade ocidental contemporânea, possibilitando assim se levantar a hipótese de adoção da lógica da justiça restaurativa para se conceder maior justiça ao sistema penal. Para se alcançar tal objetivo, pretende-se expor os problemas que o sistema que adota a justiça retributiva ocasionou à sociedade durante os séculos em que prevaleceu, englobando os problemas de apropriação do poder de resolução de conflitos por parte do Estado, excluindo-se assim as vítimas do processo penal e ainda protagoniza a questão sobre condenação discriminatória do Estado, que busca retirar da sociedade indivíduos marginalizados, pessoas essas que, na verdade, são de sua responsabilidade do próprio Estado por não ter prestado os devidos auxílios aos necessitados previsto constitucionalmente, podendo tais indivíduos apenas cometer infrações no intuito de sanar a ausência da prestação estatal de suas vidas. Tais problemas cumulados ocasionam o excesso de demandas penais no Poder Judiciário, tornando-o moroso e caro, e isso somente em razão de satisfazer os interesses do próprio Estado. Diante dessa realidade, verifica-se que a única opção que existe para se contornar tais mazelas é por meio da implementação de programas restaurativos, que aproximam a vítima, o autor do delito e toda a comunidade envolvida no fato, para, por meio de mediação, chegarem em um consenso em qual medida deve ser tomada para suplantar os danos sofridos. Assim, para se verificar a justiça no modelo descrito, lança-se a teoria de justiça concebida por Jacques Derrida, que acredita que Direito e Justiça não são termos correlatos, e que a verdadeira justiça só poderia ser produzida através da desconstrução do Direito.
Abstract: The present work aims to criticize the criminal justice system that follows the punitive logic and that prevails in all contemporary Western society, thus enabling the hypothesis of adopting the logic of restorative justice to be granted to grant greater justice to the penal system. In order to achieve this objective, it is intended to expose the problems that the system that takes retributive justice caused to society during the centuries in which it prevailed, encompassing the problems of appropriation of the power of resolution of conflicts by the State, thus excluding the victims of criminal prosecution, and is also the subject of a discriminatory condemnation of the State, which seeks to withdraw from society marginalized individuals, who are in fact the responsibility of the State itself for failing to provide the necessary aid to the needy constitutionally established, and such individuals may only commit offenses in order to remedy the absence of state provision of their lives. Such cumulative problems lead to excessive criminal prosecution in the Judiciary, making it cumbersome and costly, and this only because it satisfies the interests of the State itself. Faced with this reality, it is verified that the only option that exists to overcome such ills is through the implementation of restorative programs, which bring the victim, the perpetrator and the entire community involved in the fact, through mediation , to reach a consensus on what measures should be taken to overcome the damage suffered. Thus, in order to verify justice in the model described, the theory of justice was conceived by Jacques Derrida, who believes that Law and Justice are not related terms, and that true justice could only be produced through the deconstruction of Law.
