A responsabilidade civil do Estado decorrente de abandono afetivo de crianças e adolescentes acolhidos

Abstract

The present study aims to discuss the possibility of holding the State accountable for affective abandonment, considering that the partnerships that are used to promote the constitutional objectives for the family, and especially the treatment of children and adolescents, may eventually not comply with their children and adolescents who, due to this same noncompliance in what they have, have the family power extinct, in the worst case, passing into the hands of social organizations, governmental or otherwise, the role of full development of infants. In this sense, this work discusses from the conception of the family and its progress throughout history, the transformation by which the father power has passed to become family power, passing through the concept and procedure that culminates with the institutionalization of children and adolescents and the its subsequent availability for adoption, the discussion being permeated by the principle of affectivity and considerations pertinent to civil responsibility related to the theme
