Exame criminológico: análise e reflexão a luz dos princípios da execução penal

Abstract

The violation of the rights of the prisoners, prison overcrowding and the progressive system of penalties (as well as their ineffectiveness) are topics of great relevance in the current scenario and have been present for years in academic debates and doctrinal discussions. The right to progression of regime, in spite of being due to the State and right of the victim, is constantly violated by the authorities in various ways. Among them, the creation of obstacles to the concession of the same one stands out, being one of the main consists in the requirement of the criminological examination in order to verify the "aptitude" of the reeducando for progression.
