Adolescentes em conflito com a lei e a redução da maioridade penal: um estudo exploratório a partir dos olhares de profissionais que atuam no sistema socioeducativo do Estado do Espírito Santo

Abstract

The present study aims to analyze the issues surrounding adolescents in conflict with the law. To that end, PEC 171/1993, which advocates the reduction of the criminal majority, has been discussed and seen by several parliamentarians, jurists and, mainly, by the people, as the solution to reduce crime and violence. In this way, we will consider several aspects that surround the life of adolescents, from historical factors, which over the years have brought different problems today, which, it is stressed, violate fundamental rights. There are several reasons for the interference of a being, with personality still in formation and without maturation, in the illusory world of the illicitudes, being the reflection on them. These young people are stereotyped even before they begin to commit illegalities, because of their physical and social conditions, and are taxed as the cause of the social order, and therefore punish them as a way to avoid the emergence of greater problems for society. Seeking to foment the discussions on the subject, an analysis was made on the current method of sanctioning adolescents in conflict with the law, through interviews with professionals working in this field, directly with such young people.
