metadata.dc.description.resumo: | Busca demonstrar as implicações acerca das recomendações dos itens XXII e XXIII, emitidos pelo Relatório da Comissão de Estudos acerca do Novo Código de Processo Civil sobre os impactos do mesmo no âmbito do Poder Judiciário Capixaba. Visa destacar como as mesmas apresentam profundo retrocesso diante da Política de Pacificação Social que começou a ser delimitada em 2010, pela Resolução nº 125 do Conselho Nacional de Justiça e foi incorporada pelo Novo Código de Processo Civil. Para isso, houve pesquisa legislativa acerca dos institutos que delimitaram o assunto da mediação nos últimos anos. Além disso, houve análise de dados para a constatação e formação argumentativa acerca da crise que cerca o Poder Judiciário, focando na Justiça Comum e no Tribunal de Justiça do Espirito Santo. Por fim, apresenta-se a realidade do 1º CEJUSC de Vitória, localizado no próprio Tribunal de Justiça/ES, conhecido através de pesquisa de campo, como forma de retratar como está sendo a aplicação do Novo Código e da Resolução nº 125 no âmbito capixaba. Sendo assim, será verificada a necessidade da propagação da Política de Pacificação de Conflitos, tendo em vista a possibilidade do cumprimento das medidas necessárias para a imposição da mesma, já que não foram medidas impostas de uma hora para a outra. |
Abstract: | It seeks to demonstrate the implications of the recommendations of items XXII and XXIII issued by the Report of the Study Committee on the New Code of Civil Procedure on its impacts within the scope of the Judicial Branch of Capixaba. It aims to highlight how they present a profound setback against the Social Peace Policy that began to be delimited in 2010 by Resolution 125 of the National Council of Justice and was incorporated by the New Code of Civil Procedure. For this, there has been legislative research on the institutes that delimited the subject of mediation in recent years. In addition, there was data analysis for the confirmation and argumentative training about the crisis surrounding the Judiciary, focusing on the Common Court and the Court of Espirito Santo. Finally, the reality of the 1st CEJUSC of Vitoria, located in the Court of Justice / ES, known through field research, is presented as a way of portraying how the application of the New Code and Resolution nº 125 in the Espírito Santo area . Therefore, it will be verified the need to propagate the Conflict Peace Policy, in view of the possibility of complying with the necessary measures to impose it, since they were not imposed measures from one hour to the other. |
