metadata.dc.description.resumo: | O presente estudo tem como objetivo discutir a possibilidade do exame de DNA compulsório como meio de prova para o Direito Processual Penal brasileiro. A redação dada pela lei 12.654/2012 alterou as leis de Identificação Criminal e de Execuções Penais, sob a justificativa da necessidade de se prever a realização de uma nova espécie de identificação criminal, sendo esta, a coleta de material biológico para a obtenção do perfil genético. Acerca dessa temática, faz-se necessário discutir também as características que permeiam o sistema processual penal brasileiro, as provas nele admitidas, além das intervenções corporais e eventuais conflitos da Lei de Identificação Genético-Criminal, com as garantias fundamentais, em especial com o nemo tenetur se detegere, e os direitos que dele se depreendem. Ademais, o presente trabalho demonstra os diferentes entendimentos acerca do tema a partir de um estudo bibliográfico e jurisprudencial, sem prejuízo da colocação dos aspectos jurídicos e principiológicos que envolvem a utilização da tipagem genética para fins criminais, quando o investigado ou réu nega-se a fazê-la. |
Abstract: | The present study aims to discuss the possibility of compulsory DNA testing as a means of proof for the Brazilian Criminal Procedural Law. The wording given by Law 12,654 / 2012 changed the Criminal Identification and Criminal Enforcement laws, under the justification of the need to provide for a new kind of criminal identification, which is the collection of biological material to obtain the profile genetic. Regarding this subject, it is also necessary to discuss the characteristics that permeate the Brazilian criminal procedural system, the evidence accepted in it, as well as the corporal interventions and eventual conflicts of the Genetic-Criminal Identification Law, with the fundamental guarantees, especially with nemo tenetur is detegere, and the rights that appear to him. In addition, the present work demonstrates the different understandings about the subject from a bibliographical and jurisprudential study, without prejudice to the placement of legal and principiological aspects that involve the use of genetic typing for criminal purposes, when the investigated or defendant refuses to do it. |
