| metadata.dc.description.resumo: | O presente trabalho de conclusão de curso analisa o instituto da adoção e seu processo burocrático que tem por fim a certeza da decisão de adotar, e a criação de um vínculo entre os pais adotivos e a criança adotada. Porém, passado este processo, existem casos de devolução da criança, sem zelar pelo melhor interesse da criança, fazendo com que ela viva um trauma, causado por esse segundo abandono afetivo. Nesse sentido, aplica-se a teoria da responsabilidade civil objetiva no que tange ao pagamento de indenização causada pelo descumprimento do dever de família de cuidado, pelo rompimento da filiação e do poder familiar. Além disso, o magistrado deve exigir que os pais adotivos garantam um tratamento psicológico para a acriança superar essa confusão mental e esse sentimento de rejeição, podendo também exigir dano moral. |
| Abstract: | The present work of conclusion of course analyzes the institute of adoption and its bureaucratic process, which is aimed at the certainty of the decision to adopt, and the creation of a bond between the adoptive parents and the adopted child. However, after this process, there are cases of return of the child, not care for the best interest of the child, causing her to live a trauma, caused by this second affectionate abandonment. In this sense, the theory of objective civil liability applies to the payment of indemnity caused by noncompliance with the duty of a family of care, by breaking family memberships and family power. In addition, the magistrate must demand that the adoptive parents guarantee a psychological treatment for the child to overcome this mental confusion and that feeling of rejection, and may also demand moral damages. |
