metadata.dc.description.resumo: | O presente estudo tem por objetivo promover uma análise sobre a problemática emanada do uso das técnicas de reprodução humana assistida, com enfoque na fecundação heteróloga, no referente a colisão de dois direitos fundamentais vinculados a preservação da dignidade da pessoa humana. Enquanto alguns estudiosos defendem a existência e a necessidade da garantia do anonimato do doador de gametas frente ao direito à preservação da sua intimidade e privacidade, outros argumentam a possibilidade de quebra dessa garantia pelo direito do indivíduo gerado de conhecer a sua origem genética, podendo, com isso, ter acesso às informações civis do seu genitor. Considerando a inexistência de regulamentação normativa sobre essa temática, buscando harmonizar a evolução da biotecnologia com a proteção dos direitos humanos e constitucionais, discorrerá sobre quais são as atuais implicações desse empate no universo jurídico, em especial no direito de família. Além disso, abordará sobre a possível aplicação do critério de ponderação de interesses, a partir do uso da relativização desses direitos e princípios, com base na proporcionalidade e na razoabilidade. |
Abstract: | The present study aims to promote an analysis of the problematic of the use of assisted human reproduction techniques, with a focus on heterologous fertilization, regarding the collision of two fundamental rights linked to the preservation of the dignity of the human person. While some scholars argue for the existence and necessity of guaranteeing the donor's anonymity regarding the right to preserve their privacy and privacy, others argue the possibility of breach of this guarantee by the right of the individual generated to know its genetic origin, thereby having access to the civil information of his / her parent. Considering the lack of normative regulations on this subject, seeking to harmonize the evolution of biotechnology with the protection of human and constitutional rights, will discuss what are the current implications of this tie in the legal universe, especially in family law. In addition, it will address the possible application of the criterion of weighting interests, based on the use of relativization of these rights and principles, based on proportionality and reasonableness. |
