Abstract

The present study presented alternative measures to those normally adopted in the fight against violence among soccer fans in Brazil, seeking inspiration from the Taylor Report, a paradigmatic document in the evolution of English football. In order to do so, an analysis was made of the fundamental rights colliding in the context of fights among fans, such as public safety and the rights of freedom of movement and meeting of the supporter. That said, we sought to understand how the interpreter should act when confronting a conflict between such fundamental rights in an attempt to take the necessary action to resolve the situation. It was concluded that the best way is to try to reach a balance in the affirmation and restriction of rights, depending on each case. Afterwards, an analysis was made of the problem of violence between supporters in Brazil, dealing with the organized cheerleaders and the measures that are normally taken by the State to combat the problem, such as single cheer, penalties for clubs and penalties for organized cheerleaders. It was tried to demonstrate that the way in which the problem is treated is not the most adequate and can not find the balance in the affirmation and restriction of the fundamental rights previously opposed. Finally, the work proposed a series of measures based on the Taylor Report, a fundamental document in the fight against hooligans, except for the differences with the organized Brazilian fans. There have been reports of striking tragedies involving such groups in England, culminating in the writing of the Taylor Report. Finally, proposals were made based on the CCTV surveillance system and the Football Membership Scheme Access Card policy. It was found that such measures, if perfected, planned and executed, may have a more satisfactory result in combating violence among soccer supporters in Brazil, than those normally taken.
