Estado e alteridade no debate entre o inimigo no direito penal e o drama de Dario Fo

Abstract

The present work analyzes the relationship between the Enemy Criminal Law theory and the State project in the works of Gunther Jakobs and Carl Schmitt through the interface psychoanalysis, literature and language theory. In order to identify the role of the enemy in the production of state models, the presence of the enemy in the liberal forms of State is considered, based on the studies of the Argentine critical criminal Raul Zaffaroni, as well as its implications for the contemporary constitutional democracies. Finally, the criminological knowledge listed for the analysis of the dramatic work of Dario Fo, Accidental Death of an Anarchist, will be applied.
