dc.description.abstractThe purpose of this paper is to give priority to the rights and dignity of the non-rational living being, giving a brief analysis of the Brazilian legal system, especially article 225 of the Federal Constitution of 1988, Law 9605/1998 and other provisions most recent articles dealing with the non-rational animal. Thus, there was a clear intention to show the incompleteness of Brazilian law regarding the guarantees of the non-rational living being, and, consequently, its objectification, the negligence of man as to the welfare of the animal as well as the consequences generated by it. It is explained in the present study why the animal has the right to dignity of life, also proposing constructive measures to all - measures that would generate an improvement in the condition of the non-rational animal, also bringing benefits to the whole society in scope general. Explanations of the most diverse forms of ill-treatment with the non-rational living being and the absurdity of human action came to light.pt_BR
dc.description.resumoO presente trabalho tem como intuito prezar pelos direitos e dignidade do ser-vivo não racional, trazendo uma breve análise do ordenamento jurídico brasileiro, sendo observado, em especial, o artigo 225 da Constituição Federal de 1988, a Lei 9.605/1998 e outras disposições mais recentes que versam sobre o animal não racional. Dessa forma, houve a clara intenção de mostrar a incompletude do Direito brasileiro no tocante às garantias do ser vivo não racional, e, conseqüentemente, sua objetificação, a negligência do homem quanto ao bem estar do animal bem como quanto às conseqüências geradas por isso. Explica-se, no presente estudo, o por quê do animal ter o direito à dignidade de vida, propondo também medidas construtivas à todos – medidas essas que gerariam uma melhoria na condição do animal não racional, trazendo também vantagens para toda a sociedade em âmbito geral. Veio à tona explicações das mais diversas formas de maus tratos com o ser vivo não racional e quão absurdo pode chegar a ação humana.pt_BR
