| metadata.dc.description.resumo: | O presente trabalho tem como principal questionamento a existência ou não da previsão legal do direito de não produzir prova contra si mesmo e como a pretensa previsão legal se coloca diante do sistema normativo pátrio. Para isso, faz-se uma análise da evolução histórica do nemo tenetur se detegere e de como este principio está presente no direito brasileiro. Após, faz-se o questionamento de como o texto normativo deve ser interpretado com a finalidade de promover os direitos fundamentais individuais e sociais. Para isso, averigua-se a hermenêutica do texto normativo em confronto com a Constituição Federal para chegar a conclusão da existência ou não do nemo tenetur se detegere no direito brasileiro. |
| Abstract: | The present work has as main questioning the existence or not of the legal prediction of the right not to produce evidence against itself and how the supposed legal prediction is placed before the normative system patria. For this, an analysis is made of the historical evolution of nemo tenetur detegere and of how this principle is present in Brazilian law. After that, the question is raised as to how the normative text should be interpreted in order to promote fundamental individual and social rights. For this, the hermeneutics of the normative text in comparison with the Federal Constitution is investigated to arrive at the conclusion of the existence or not of nemo tenetur is detegere in Brazilian law. |
