Title: A corrupção passiva de agentes políticos : uma desconstrução do imaginário social punitivista midiático

metadata.dc.description.resumo: O presente estudo tem como objetivo analisar a efetividade da aplicação do sistema penal nos crimes de corrupção passiva cometidos por agentes políticos. Para tanto, foram analisados os diferentes posicionamentos jurídicos acerca da ampliação e do endurecimento das leis penais para o combate à corrupção, tendo como base as 10 medidas contra a corrupção, desenvolvidas pelo Ministério Público Federal. A pesquisa considerou o contexto dos últimos anos, em que houve uma transformação no tratamento jurídico-penal dado a esses tipos de crimes, principalmente a partir dos caminhos percorridos pela operação lava-jato. Como consequência, houve a intensificação de veiculação midiática de noticias envolvendo os crimes de colarinho branco. Nesse ínterim, a partir da criminologia crítica e midiática, buscou-se desenvolver um pensamento critico dominante da mídia, forma um pensamento pautado em uma realidade distorcida, que não considera os perigos ao Estado Democrático de Direito causados pela relativização das regras processuais e constitucionais, os reais interesses políticos e econômicos por trás da busca pelo combate à corrupção dos agentes políticos, o comportamento tradicionalmente seletivo do sistema penal e da mídia. Assim, o trabalho propõe levantar esses contrapontos, que são ocultados da narrativa midiática e do trabalho realizado por membros do judiciário e do Ministério Publico no combate à corrupção.
Abstract: The present study aims to analyze the effectiveness of the application of the penal system in crimes of passive corruption committed by political agents. To this end, the different legal positions regarding the expansion and hardening of criminal laws to combat corruption were analyzed, based on the 10 anti-corruption measures developed by the Federal Public Ministry. The research considered the context of recent years, where there has been a transformation in the legal-penal treatment given to these types of crimes, mainly from the paths covered by the jet-laundering operation. As a consequence, there was an intensification of media coverage of news involving white collar crimes. In the meantime, based on critical and mediatic criminology, we sought to develop a dominant critical thinking of the media, forming a thought based on a distorted reality, which does not consider the dangers to the Democratic State of Law caused by the relativization of procedural and constitutional rules, the real political and economic interests behind the search for the fight against corruption of political agents, the traditionally selective behavior of the penal system and the media. Thus, the work proposes to raise these counterpoints, which are hidden from the media narrative and the work done by members of the judiciary and the Public Ministry in the fight against corruption.
