| metadata.dc.description.resumo: | Busca analisar a infância transgressora, bem como as medidas socioeducativas aplicadas aos adolescentes infratores, levando em consideração a eficácia destas em ressocializar e reintegrar estes à sociedade. Compreensão dos processos de socialização que ocorrem durante a infância, além da determinação de quando o sujeito passa a ser considerado um sujeito adulto, perante si e perante a sociedade. Estudo da realidade histórica brasileira, no que tange aos direitos envolvendo as crianças e adolescentes em conflito com a lei. O método utilizado para coletar os dados consistiu em análise das informações fornecidas pela 2ª Vara da Infância e Juventude de Serra/ES, cujos processos envolvendo apuração de ato infracional foram estudados. Dados sociais dos adolescentes infratores foram observados, principalmente no que tange à capacidade econômica e a vida acadêmica. Os dados obtidos possibilitaram a conclusão de que as medidas atualmente aplicadas no município não observam a necessidade de ressocialização do adolescente em conflito com a lei, mas tão somente punem o ato infracional praticado, não alterando desigualdades sociais já existentes e demonstrando sua ineficácia quanto ao caráter ressocializador. |
| Abstract: | It seeks to analyze transgressive childhood, as well as socio-educational measures applied to juvenile offenders, taking into account their effectiveness in resocializing and reintegrating them into society. Understanding the processes of socialization that occur during childhood, beyond the determination of when the subject happens to be considered an adult subject, before him and before society. Study of the Brazilian historical reality, regarding the rights involving children and adolescents in conflict with the law. The method used to collect the data consisted of an analysis of the information provided by the 2nd Child and Youth Court of Serra / ES, whose processes involving investigation of infraction were studied. Social data of the offending adolescents were observed, mainly regarding economic capacity and academic life. The data obtained allowed the conclusion that the measures currently applied in the municipality do not observe the need for resocialization of the adolescent in conflict with the law, but only punish the infraction act practiced, not altering existing social inequalities and demonstrating their inefficacy as to the character resocializer. |
