| metadata.dc.description.resumo: | O presente trabalho tem como objetivo principal analisar de que maneira o Direito brasileiro tem se posicionando frente às mudanças ocorridas em torno do conceito de família. Isso porque, sabe-se que a sociedade está em constante evolução, de forma que, na esfera familiar, não poderia ser diferente. Inicialmente tem-se uma elucidação histórica da família até os dias atuais, atingindo o foco do presente trabalho. No segundo capítulo, por sua vez, será analisado alguns institutos jurídicos que foram reconhecidos dentro dos novos arranjos familiares. No capítulo seguinte, em contraste com o segundo capítulo, é destinado a mostrar que ainda resiste divergências quanto à aceitação e reconhecimento dos novos modelos familiares. Por fim, procura-se trazer ao estudo a questão da família como entidade afetiva, em outras palavras, busca-se valorizar a presença do afeto no âmbito das relações familiares. |
| Abstract: | The main objective of this study is to analyze how Brazilian law has been positioning itself in the face of the changes that have taken place around the concept of family. This is because, it is known that society is constantly evolving, so that in the family sphere, it could not be different. Initially there is a historical elucidation of the family up to the present day, reaching the focus of the present work. In the second chapter, in turn, will be analyzed some legal institutes that have been recognized within the new family arrangements. In the next chapter, in contrast to the second chapter, it is intended to show that it still resists disagreements regarding the acceptance and recognition of new family models. Finally, we try to bring to the study the question of the family as an affective entity, in other words, it seeks to value the presence of affection in the context of family relationships. |
