| Resumo: | O presente trabalho tem por objetivo analisar o tratamento dispensado pelo atual sistema constitucional brasileiro à tutela dos direitos humanos, com enfoque na problemática da inserção, em nosso ordenamento vigente, das normas e garantias veiculadas em tratados e convenções internacionais que versam sobre os mesmos. A partir do estudo das modificações implementadas pela Emenda Constitucional nº 45/2004, buscou-se demonstrar que a mudança introduzida no texto constitucional, no que se refere à incorporação do direito internacional ao pátrio, embora decorrente da constante e crescente preocupação com a atribuição de maior eficácia aos mecanismos de proteção dos direitos humanos, pouco ou nada contribuiu para a solução do problema da efetividade de tais direitos. Longe de representar obstáculo enfrentado exclusivamente pelo sistema nacional, a questão da efetividade da tutela destes direitos é deficiência verificada em âmbito mundial, que, apesar de contar com moderno e avançado aparato normativo, ainda se depara com uma tímida aplicação pelas cortes responsáveis por assegurar sua observância. |
| Abstract: | This work intends to analyze how the Brazilian constitutional system handles the protection of human rights, focusing on the inclusion in our current legislation of the rules and guarantees issued by international treaties and conventions that deal with this matter. Based on the study of the modifications implemented by 45/2004 Amendment, we seek to demonstrate that the changes concerning the incorporation of international rights into the national law, which were inserted in the constitutional text in order to fulfill a growing preoccupation with the efficiency of the mechanisms for the protection of human rights, contributed little or nothing to the solution of the problem of the effectiveness of those rights. Far from representing an obstacle only to our system, the low effectiveness of the protection of human rights is a deficiency noticed worldwide. Despite the modern and advanced legal apparatuses, the courts responsible for ensuring the observance of those rights are still applying them very timidly. |
