dc.description.abstractThis work analyzes PL 2.303 / 15 and its possible contribution to a greater protection and regulation of the use of cryptomoedas, based on the Japanese experience and the Brazilian constitutional principles of privacy and freedom. Conceptual conceptual delimitation of what are bitcoin, altcoins and blockchain, along with study of the constitutional principles of freedom and privacy in the digital scope. Analysis of the bill and its justifications, as well as an examination of the Japanese reality with regard to the regulation of crypto-coins in its territory. The development and conclusion of the text demonstrate that PL 2.303 / 15, in the search for effective regulation based on international experiences, can not fully comprehend the importance and usefulness of crypto-coins and blockchain. Bacen and CVM seek to manifest themselves through notes and clarifications with sometimes opposing positions. Reflection of the private interests of the institutions involved, especially the banking conglomerates.pt_BR
dc.description.resumoPor meio deste trabalho, analisa-se o PL 2.303/15 e sua possível contribuição para uma maior proteção e regulamentação do uso das criptomoedas, com base na experiência japonesa e nos princípios constitucionais brasileiros de privacidade e liberdade. Delimitação conceitual teórica do que são a bitcoin, as altcoins e a blockchain, junto com estudo dos princípios constitucionais de liberdade e privacidade no âmbito digital. Análise do projeto de lei e de suas justificativas, bem como exame da realidade japonesa no que diz respeito à regulamentação das criptomoedas em seu território. O desenvolvimento e conclusão do texto demonstram que o PL 2.303/15, na busca de positivar uma regulamentação efetiva com base em experiências internacionais, não consegue abarcar toda a importância e utilidade das criptomoedas e da blockchain. Bacen e CVM buscam se manifestar por intermédio de notas e esclarecimentos com posições, por vezes, opostas. Reflexo dos interesses privados das instituições envolvidas, em especial dos conglomerados bancários.pt_BR
