| Título: | Maternidade substitutiva: uma análise civel e constitucional |

| Resumo: | O presente trabalho busca analisar de que modo o artigo 1.597 do Código Civil pode ser interpretado para a compreensão do significado maternidade, considerando a técnica da maternidade substitutiva. Ao estudar esta pela ótica cível - apesar de não haver nenhuma norma específica sobre o tema - percebe-se que há várias questões que entram em conflito, em oposição. Com relação à metodologia da pesquisa, o método que pauta a mesma é a dialética. Assim, é necessário conceituar os tipos mais comuns das técnicas de reprodução assistida, e a relação existente entre elas, e o princípio da afetividade e do melhor interesse do menor. Ademais, trabalha-se a ideia da formação da família como um direito fundamental, e que por isso não há uma única forma de constituí-la. Desse modo, o trabalho explora o tema da maternidade substitutiva, como uma garantia do direito à maternidade e a questão da filiação, dentro da mesma. |
| Abstract: | The present work seeks to analyze how Article 1,597 of the Civil Code can be interpreted to understand the meaning of maternity, considering the technique of substitutive motherhood. In studying this from the civilian perspective - although there is no specific norm on the subject - it is perceived that there are several conflicting issues, in opposition. Regarding the methodology of the research, the method that guides the same is the dialectic. Thus, it is necessary to conceptualize the most common types of assisted reproduction techniques, and the relationship between them, and the principle of affection and the best interest of the child. In addition, the idea of the formation of the family as a fundamental right is worked, and that therefore there is not a unique form to constitute it. In this way, the work explores the theme of substitutive motherhood, as a guarantee of the right to maternity and the question of membership, within the same. |
