metadata.dc.description.resumo: A presente monografia busca analisar a entrada em vigor da Lei 13.467/2017 e a (in)constitucionalidade das alterações e inovações acerca do beneplácito da gratuidade de justiça, sob o aspecto dos princípios da inafastabilidade do poder jurisdicional, da isonomia e da dignidade da pessoa humana, bem como sob a ótica da inserção de componentes reais no sistema constitucional processual trabalhista a fim de que sejam atendidas as necessidades reais das partes que demandam o Poder Judiciário. Verifica-se a alteração trazida pela Lei 13.467/2017, no que concerne à regulamentação do instituto da justiça gratuita no Direito Processual do Trabalho, encontra amparo na ordem jurídica brasileira ou a referida lei, nesse particular, afronta ao disposto no artigo 5º, incisos XXXV e LXXIV da Constituição da República de 1988. Para tanto, os dispositivos inseridos e alterados na Consolidação das Leis Trabalhistas serão relacionados ao disposto no inciso XXXV, do artigo 5º, da Constituição da República de 1988, esta que elevou o patamar dos direitos e princípios fundamentais, como forma de proteção à dignidade da pessoa humana. Posteriormente, será realizada uma crítica acerca dos dispositivos inseridos e alterados à luz do princípio da interpretação conforme a Constituição, a fim de definir sua validade no ordenamento jurídico brasileiro. Da mesma forma, estuda-se o julgamento da ação direta de inconstitucionalidade nº 5766 que tramita perante o Supremo Tribunal Federal, buscando compreender seus efeitos na Justiça do Trabalho para a parte hipossuficiente da demanda trabalhista, em especial, pela análise do direito de acesso efetivo à justiça como forma de concretização dos demais direitos fundamentais.
Abstract: This monograph seeks to analyze the entry into force of Law 13467/2017 and the (in) constitutionality of the changes and innovations regarding the approval of the gratuitousness of justice, under the aspect of the inafasability of jurisdictional power, isonomy and dignity of the person as well as from the point of view of the insertion of real components into the labor process constitutional system in order to meet the real needs of the parties that demand the Judiciary. The amendment brought by Law 13467/177, regarding the regulation of the institute of free justice in the Labor Procedural Law, is found to be protected by the Brazilian legal order or the said law, in this respect, is in breach of the provisions of article 5, subsections XXXV and LXXIV of the Constitution of the Republic of 1988. In order to do so, the provisions inserted and amended in the Consolidation of Labor Laws will be related to the provision in item XXXV of article 5 of the Constitution of the Republic of 1988, which raised the level of rights and fundamental principles, as a way of protecting the dignity of the human person. Subsequently, a critique will be made of the devices inserted and modified in the light of the principle of interpretation according to the Constitution, in order to define its validity in the Brazilian legal system. Likewise, the judgment of the direct action of unconstitutionality no. 5766 that is filed before the Federal Supreme Court is studied, seeking to understand its effects in the Labor Court for the hypersufficient part of the labor demand, in particular, by the analysis of the right of effective access to justice as a form of implementation of other fundamental rights.
