O processo de vitimização nos crimes contra a dignidade sexual: busca de redução de danos

Abstract

In view of crimes against the sexual dignity suffered, most often by women, the so-called tertiary victimization has emerged as a victimization process through which the victim passes after suffering the crime. Considering that the victim suffers from a plan of victimization caused by the perpetrator of the crime, it is called primary victimization, later, secondarily, he / she suffers secondary victimization, which is the result of public agents and judicial agents, which provide often, unprepared care for the victims of this crime, which occurs during the development of the process, and finally, there is the so-called tertiary victimization, the one in which the society, the family and the social environment in which the victim lives, the third victimization, which addresses how the victim is seen after the end of the process by the people who circulate their social environment and the way in which it is treated. Thus, it will be analyzed, in addition to the way in which the victim is treated, the force that has a say in the criminal process, its participation, its rights and, finally, the existing possibilities capable of reducing the effects of crime, which is in fact a challenge because of the complexity of the cases. Thus, in the end, in view of the findings obtained, it is demonstrated the existing means that ensure a protection and safety for victims of crimes against sexual dignity, emphasizing the need to use and improve these means to ensure their effectiveness in order to ensure to them a dignified life and to reach the objective of the present work, that is: the reduction of damages.
