O ensino doméstico (homeschooling) e seu possível reconhecimento legal no Brasil

Abstract

The present study aims to conduct a study about home teaching, also known as homeschooling, and its possible legal recognition in the Brazilian Legal Order. An investigation will be made into the origin of education in Brazil and a brief analysis of the treatment it received in the Brazilian constitutions and in the current infrastructural legislation, as well as the nature of social law inherent in education. Afterwards, an assessment will be made of homeschooling in American law, as well as the historical and cultural basis that allowed domestic education to flourish in that country. Finally, the main argument used by those who oppose the practice of home teaching will be confronted, and this is the myth of socialization. For a better examination of the work, the dialectical method will be used, which proposes to arrive at a conclusion from the arguments presented. In addition, the present study aims to highlight the importance of education in the Democratic State of Law, to question the constitutional duty of the State to provide education, to expose the modality of home teaching and to verify the extent to which there is compatibility between homeschooling and the duty of the State to provide education.
