metadata.dc.description.resumo: A presente dissertação busca investigar, do ponto de vista teórico e a partir da análise de pesquisas já realizadas e documentadas de experiências de implementação no Brasil, quais as possibilidades de aplicação da justiça restaurativa em sociedades fundadas na naturalização da desigualdade e em que medida a Criminologia da Libertação e a Teoria Crítica dos Direitos Humanos podem servir de fundamentação epistemológica e política para a construção de uma justiça restaurativa nesses países. Identifica-se, em primeiro lugar, as especificidades do processo de modernização das sociedades periféricas, do qual decorreram problemas sociais particulares, como a naturalização da desigualdade e a produção, enquanto fenômeno de massa, da subcidadania. Nesse contexto, os sistemas penais periféricos são instrumentalizados para gerir essa subcidadania e, às características inerentes a todo sistema penal, como a seletividade e a reprodução da violência, somam-se os fenômenos da invisibilidade pública, da humilhação social e da reificação. Busca-se elucidar, a partir da perspectiva crítica, como opera o controle social na América Latina. Posteriormente, examina-se o contexto em que se insere, principalmente no Brasil, a renovação do interesse pela justiça restaurativa como abordagem alternativa para se lidar com os conflitos, ressaltando a crise de legitimidade do paradigma punitivo-retributivo. Após, passa-se a investigar a justiça restaurativa, compreendida como um modelo de justiça essencialmente relacional, bem como os princípios e os valores que norteiam os processos restaurativos, além das contribuições abolicionistas para a estruturação da justiça restaurativa, desde uma perspectiva transformadora. Examinam-se, ainda, as práticas restaurativas implementadas no Brasil, bem como a mitologia da Justiça Restaurativa no Brasil, identificada, na pesquisa coordenada por Vera Regina Pereira de Andrade, como obstáculo epistemológico e político à potencialização dos ideais restaurativos. Por fim, a partir da Criminologia da Libertação, de Lola Aniyar de Castro, e da Teoria Crítica dos Direitos Humanos, de Joaquín Herrera Flores, busca-se não formalizar uma teoria da justiça restaurativa, mas situar a justiça restaurativa no contexto das sociedades periféricas, fundadas na naturalização da desigualdade, e elucidar os desafios e os fundamentos políticos e epistemológicos para sua implementação nessas sociedades. Defende-se que, à luz dos referidos marcos teóricos, para que uma justiça restaurativa fundada no paradigma relacional seja possível nesse contexto de naturalização da desigualdade, de negação da vítima e de condições que dificultam a comunicação de cidadãos iguais, há a necessidade de enfrentamento da realidade das sociedades periféricas, não de sua ocultação, a partir do compromisso com os esforços de libertação humana e da denúncia das situações que marcam essas realidades sociais, bem como com o empoderamento dos grupos tradicionalmente marginalizados e oprimidos, postulando-se, assim, uma justiça restaurativa da libertação (da deslegitimação), contextualizada na realidade dos países periféricos e voltada para os problemas específicos dessas sociedades. Para tanto, o instrumental epistemológico e metodológico adotado foi a hermenêutica crítica, associada à sociologia do conhecimento, que impulsiona a questionar a legitimidade teórica.
Abstract: The present dissertation seeks to investigate, from a theoretical point of view and based on the analysis of already performed and documented research on implementation experiences in Brazil, what are the possibilities of applying restorative justice in societies founded on the inequality naturalization and to what extent Criminology of liberation and the Critical Theory of Human Rights can serve as epistemological and political grounds for the construction of restorative justice in these countries. First, we identify the specificities of the process of modernization of peripheral societies, that lead to particular social problems, such as the naturalization of inequality and the production, as a mass phenomenon, of sub-citizenship. In this context, the peripheral criminal systems are instrumental in managing this subcitizenship and the phenomena of public invisibility, social humiliation and reification are added to the inherent characteristics of any criminal system, such as selectivity and reproduction of violence. It seeks to elucidate, from the critical perspective, how social control operates in Latin America. Subsequently, it examines the context in which it is inserted, especially in Brazil, the renewal of interest in restorative justice as an alternative approach to dealing with conflicts, highlighting the crisis of legitimacy of the punitive-retributive paradigm. After that, we proceed to investigate restorative justice, understood as an essentially relational model of justice, as well as the principles and values that guide the restorative processes, as well as the abolitionist contributions to the structuring of restorative justice, from a transformative perspective. We also examine the restorative practices implemented in Brazil, as well as the mythology of Restorative Justice in Brazil, identified in the research coordinated by Vera Regina Pereira de Andrade, as an epistemological and political obstacle to the enhancement of restorative ideals. Finally, from the Criminology of Liberation, by Lola Aniyar de Castro, and the Critical Theory of Human Rights, by Joaquín Herrera Flores, we seek not to formalize a theory of restorative justice, but to situate restorative justice in the context of peripheral societies, based on the naturalization of inequality, and to elucidate the challenges and the political and epistemological foundations for their implementation in these societies. It is argued that, in the light of the aforementioned theoretical frameworks, for a restorative justice based on the relational paradigm to be possible in this context of naturalization of inequality, denial of the victim and conditions that hinder the communication of equal citizens, there is a need for confrontation of the reality of the peripheral societies, not of their concealment, from the commitment to the efforts of human liberation and denunciation of the situations that mark these social realities, as well as with the empowerment of the groups traditionally marginalized and oppressed, postulating a restorative justice of liberation (of delegitimation), contextualized in the reality of peripheral countries and focused on the specific problems of these societies. In order to do so, the epistemological and methodological instruments adopted were critical hermeneutics, associated with the sociology of knowledge, which prompted to question the theoretical and political legitimacy of the criminological discourses within the stratified social order.
