O populismo contra o Estado de direito: a crise da democracia na “era digital”

Abstract

Populist attempts – perceived here as an attempt to break with the Rule of Law in the name of meeting institutionally repressed demands –, associated with high levels of political polarization, allow for a constant flirtation with the taking root of democracies considered illiberal. Seeking to support this argument, this study is divided into two parts. The first seeks to scrutinize, within the limits of this proposal, the distances and approximations typical of the often tense dialogue between Law and Politics. The second – based on this perspective considered angular for democratic architecture – points to the relationship between populism – considered a political particularity with legal consequences – and the rise of democracies considered illiberal.
