Retórica e política da fé: o nonsense comum dos juristas sobre os Direitos Humanos

Abstract

This article analyzes the normative rhetoric of human rights and its decoupling of socio-economic and political-cultural assumptions, a characteristic that turns against its own pretension of effectiveness. For this purpose, it considers that the cultural transformation that gave the human being cognitive abilities is the same as that which leads to the inclination to escape to imagined realities, which conform to the ideal of perfectibility and relieve the existential tension. The text highlights an atavistic resistance to skepticism and a preference for sympathetic emancipatory promises, even if surrounded in conditions that deny its political feasibility. This kind of alienation has debilitating effects on human rights practices and makes it imperative to give that rhetoric greater sustainability. To underscore this need is the objective of this work, which proposes the use of a strategic rhetoric anchored in realistic perceptions of contemporary complexity.
