| metadata.dc.description.resumo: | O presente artigo tem como objetivo explicar e propor uma hermenêutica jurídica a partir da retórica. Para isso, em um primeiro momento, apresenta-se a hermenêutica como um dos “constrangimentos” do direito dogmaticamente organizado. Em um segundo instante, explica-se como ela era compreendida pelo positivismo jurídico do século XIX. E, a seguir, discorre-se sobre a compreensão de Hans-Georg Gadamer e a sua hermenêutica filosófica. Para, ao final, propor uma hermenêutica retórica para institucionalização do controle público da linguagem. |
| Abstract: | The present article aims to explain and propose a legal hermeneutics based on rhetoric. For this, in a first moment, hermeneutics is presented as one of the “constraints” of the dogmatically organized law. In a second moment, it is explained how it was understood by the legal positivism of the 19th century. And then, the understanding of Hans-Georg Gadamer and his philosophical hermeneutics is discussed. Finally, a rhetorical hermeneutics is proposed for the institutionalization of the public control of language. |
