| metadata.dc.description.resumo: | Procura-se a partir deste estudo analisar a possibilidade de realização da liberdade social na esfera do Direito, apesar das críticas de Axel Honneth às teorias da justiça erigidas a partir desse paradigma. Parte-se de um exame da crise do Estado democrático constitucional sob a perspectiva de um suposto sequestro da vontade-pública nas novas esferas comunicativas, especialmente a partir do advento das plataformas de redes sociais, para, num segundo momento, analisar o papel do constitucionalismo e as possibilidades institucionais de realização da liberdade social honnethiana no espaço político da jurisdição constitucional e o seu papel para o reconhecimento de grupos minoritários. |
| Abstract: | The aim of this study is to analyze the possibility of realizing social freedom in the sphere of Law, despite Axel Honneth’s criticisms of theories of justice built from this paradigm. It starts with an examination of the crisis of the constitutional democratic State from the perspective of a supposed kidnapping of the public will in the new communicative spheres, especially from the advent of social network platforms, to, in a second moment, analyze the role of constitutionalism and the institutional possibilities of realizing Honneth’s social freedom in the political space of constitutional jurisdiction and its role in the recognition of minority groups. |
