Resumo: | The present study problematizes the process of concretizing general clauses, taken as “blank checks” delivered to the decision-maker, the authentic interpreter, in the sphere of institutionality of the urisdiction of private law and its contribution to the legitimization of the Judiciary within society, the light of Niklas Luhmann’s theory of legitimation by procedure. As a hypothesis, it is assumed that a process of implementing general clauses that are transparent and coherent with the legal system can reduce the insecurity of social relations, providing legitimacy from the procedure for creating the law in the specific case, observing criteria of communicative coherence, such as nonambiguity, cohesion, thematic continuity, intentionality, mutual acceptability, and situationality. As a general objective, we analyze the process of implementing general clauses by judges who are considered models of behavior and valuation guidelines not described in the general clause. However, they are interrelated with the legitimacy of the Judiciary and the SDGs/UN, particularly SDG16, subitem 16.6 whose goal is “to develop effective, responsible and transparent systems for the administration of justice.” The research is developed along the lines of Semiology and Institutions of the Justice System, with bibliographic and documentary reviews being adopted as methodological procedures, with content analysis and critical propositions. The expected results highlight the importance of the quality decision-making process for the implementation of general clauses and the legitimization of the Judiciary, subject to adequate justification, and the participation of the parties, which contribute to the trust and stability of the legal system. |
Abstract: | O presente estudo problematiza o processo de concretização de cláusulas gerais, tidas como “cheques em branco” entregues ao decisor, o intérprete autêntico, na esfera da institucionalidade da jurisdição de direito privado e sua contribuição para a legitimação do Poder Judiciário na sociedade , à luz da teoria da legitimação por procedimento de Niklas Luhmann. Como hipótese, assume-se que um processo de implementação de cláusulas gerais transparentes e coerentes com o ordenamento jurídico pode reduzir a insegurança das relações sociais, conferindo legitimidade ao procedimento de criação da lei no caso concreto, observados critérios de coerência comunicativa , como não ambigüidade, coesão, continuidade temática, intencionalidade, aceitabilidade mútua e situacionalidade. Como objetivo geral, analisamos o processo de implementação de cláusulas gerais por juízes que são considerados modelos de comportamento e diretrizes de valoração não descritas na cláusula geral. Contudo, estão inter-relacionados com a legitimidade do Poder Judiciário e dos ODS/ONU, em especial o ODS16, subitem 16.6, cujo objetivo é “desenvolver sistemas eficazes, responsáveis e transparentes para a administração da justiça”. A pesquisa desenvolve-se nos moldes da Semiologia e das Instituições do Sistema de Justiça, adotando-se como procedimentos metodológicos revisões bibliográficas e documentais, com análise de conteúdo e proposições críticas. Os resultados esperados destacam a importância do processo decisório de qualidade para a implementação das cláusulas gerais e a legitimação do Poder Judiciário, mediante adequada justificativa, e a participação das partes, que contribuem para a confiança e estabilidade do sistema jurídico. |
