| metadata.dc.description.resumo: | A mudança climática é considerada a maior problemática ambiental enfrentada pelos países de todo o mundo. Trata-se de uma pauta global, de extrema urgência, já sendo considerada como irreversível caso não haja uma mudança drástica nos próximos anos. O aumento da temperatura global decorre das emissões constantes de gases de efeito estufa, provocando o derretimento das geleiras, grandes queimadas e alteração na biodiversidade. Grande parte das emissões de gases de efeito estufa advém da produção em larga escala do plástico, material derivado de combustíveis fósseis, um dos principais emissores. Além do fato da produção do plástico impactar diretamente a alteração climática, durante todo o ciclo de vida desse material, há emissão de gases, ou seja, não se trata apenas do momento de produção, mas de todo o seu ciclo. Nesse sentido, deve ser considerado também o consumo exagerado e a destinação incorreta do plástico, gerando manchas de lixo nos oceanos, além de massas flutuantes e pastosas de microplásticos que se dissipam por todos os ambientes, sendo identificado até mesmo no leite materno. Diante desse cenário de urgência, surge a necessidade de criar um Regime Internacional do Plástico, com o intuito de determinar normas jurídicas vinculantes e ações eficazes de enfrentamento da problemática. Nesse sentido, destaca-se a importância das Interligações Institucionais Horizontais entre o Regime Internacional das Mudanças Climáticas e o Regime Internacional do Plástico, uma vez que, com a conexão das normas, regras e princípios, é possível afastar possíveis lacunas e antinomias jurídicas, de maneira em que o Regime seja considerado robusto e eficaz. Dessa forma, os Estados devem se responsabilizar em promover ações eficazes e imediatas no que tange ao enfrentamento das mudanças climáticas, por se tratar de uma pauta de urgência, que impacta as gerais atuais e futuras. Sendo assim, o presente estudo tem por objetivo analisar as potencialidades do Regime Internacional do Plástico no processo de desenvolvimento institucional do Regime Internacional de Mudanças Climáticas e seu desempenho na conformidade de suas metas políticas. |
| Abstract: | Climate change is considered the most significant environmental issue faced by countries around the world. It is a global agenda of extreme urgency, already deemed irreversible without a drastic change in the coming years. The increase in global temperatures is a result of constant emissions of greenhouse gases, leading to glacier melting, extensive wildfires, and alterations in biodiversity. A significant portion of greenhouse gas emissions stems from the large-scale production of plastic, a material derived from fossil fuels, one of the major contributors. Besides the fact that plastic production directly impacts climate change, emissions of gases occur throughout the entire lifecycle of this material. It's not just about the production phase but the entire lifecycle. In this context, excessive consumption and improper disposal of plastic should also be considered, leading to ocean garbage patches and microplastics dispersing throughout various environments, even being found in breast milk. Given this urgent scenario, there is a need to establish an International Plastic Regime aimed at determining binding legal standards and effective measures to address this issue. In this regard, the importance of Horizontal Institutional Linkages between the International Climate Change Regime and the International Plastic Regime is emphasized. Connecting norms, rules, and principles can help eliminate potential legal gaps and contradictions, ensuring that the regime is robust and effective. That way, states must take responsibility for implementing immediate and effective actions to address climate change, as it is an urgent agenda that impacts both current and future generations. Therefore, this study aims to analyze the potential of the International Plastic Regime in the institutional development process of the International Climate Change Regime and its performance in achieving its policy goals |
