O caso do "massacre do Carandiru": uma análise das espécies de vitimização experimentadas pelos detentos e seus familiares, sob a ótica da vitimologia penal

Abstract

The research investigates the processes of criminal victimization resulting from the Carandiru Massacre and how this has had repercussions on the lives of those affected, using the deductive method and a qualitative approach to the problem. Initially, the work seeks to narrate how the massacre took place and its different versions, and how the criminal proceedings resulting from it took place. Then, beginning the analysis of the victimizing processes identified, an analysis was made of what life was like in prison at the Carandiru Complex, as well as the physical structure of the place, characterizing the primary victimization of all the inmates who served their sentences there. With regard to the criminal proceedings resulting from the massacre, the secondary victimization of the victims was identified, mainly due to the fact that the case is still pending before the São Paulo Court of Justice. The primary victimization of the victims' relatives was also inferred, since they were also affected by the Massacre, as well as by the slowness of the Judiciary. Ultimately, the process of secondary victimization of the victims' relatives was identified as a result of the civil process for compensation, since it was not very successful, if at all. In conclusion, it was found that the Carandiru Massacre was insufficient to prevent the problems identified throughout the text from recurring in the country, as well as being a violation of the fundamental rights and access to justice of inmates, victims and their families, reinforcing the state's negligence towards these individuals.
