metadata.dc.description.resumo: | O presente trabalho versa sobre a relação entre o sistema de responsabilidade civil e a inteligência artificial. Para traçar tal objetivo, é posto, de início, o desenvolvimento histórico e o panorama geral da inteligência artificial, passando desde sua origem até os dias atuais. Em seguida, é analisada a partir de fontes clássicas as possíveis definições existentes que contém a Inteligência Artificial, sendo a mais relevante aquela proposta por Alan Turing. Reconhecida as definições, aspectos filosóficos são traçados para se buscar entender como funciona o aprendizado de máquinas (machine learning) e como isso afeta o sistema pátrio principiológico decorrido da Constituição Federal de 1988. Realizada tais considerações, volta-se olhar para o estudo da teoria da responsabilidade civil, desde seus elementos compositivos - ação ou omissão, conduta, o nexo causal existente e dano ocasionado -, voltado sempre a uma análise aplicada à inteligência artificial. Por fim, é feito uma análise do projeto de lei 2338/2023, que tem com parâmetro estabelecer diretrizes de uso da inteligência artificial em território nacional como também preencher a lacuna existente no ordenamento jurídico acerca da responsabilidade civil pertinente ao caso, e a resolução do parlamento europeu quanto ao regime de responsabilidade civil aplicável à inteligência artificial como forma de parâmetro para outros sistemas jurídicos |
Abstract: | The present work deals with the relationship between the civil liability system and the artificial intelligence. To trace this objective, the historical development and the general panorama of artificial intelligence, from its origins to the present day. In then, from classical sources, the possible existing definitions containing the Artificial Intelligence, the most relevant being that proposed by Alan Turing. recognized definitions, philosophical aspects are traced to try to understand how the machine learning and how it affects the home system principle derived from the Federal Constitution of 1988. Having made such considerations, turns to look at the study of the theory of civil responsibility, from its elements components - action or omission, conduct, the existing causal link and damage caused -, always focused on an analysis applied to artificial intelligence. Finally, an analysis of the bill 2338/2023, whose parameter is to establish guidelines for the use of intelligence artificial in the national territory as well as filling the existing gap in the planning legal about the civil responsibility pertinent to the case, and the resolution of the parliament European Union on the civil liability regime applicable to artificial intelligence as Parameter form for other legal systems |
