| metadata.dc.description.resumo: | O presente trabalho tem como objetivo direcionar um estudo acerca da violência obstétrica e suas formas de manifestação como aspectos que põem em discussão os direitos fundamentais da mulher parturiente. Para tanto, será abordada a jornada pela qual se institucionalizou o parto, isto é, a saída do ambiente familiar para a instituição hospitalar e a retirada da gestante como protagonista do parto, o que foi responsável pelo aumento da vulnerabilidade e lesão aos direitos fundamentais da mulher. Desta feita, será exposta a ofensa à dignidade da pessoa humana, provocada pela violência institucional, bem como será apreciada a necessidade de maior tutela aos direitos da personalidade, vez que mostra-se como extensão para concretude do princípio da dignidade humana, além de analisar a reforma do parto a partir da concepção de direitos reprodutivos e sexuais como direitos humanos. Ademais, o estudo será direcionado à análise dos aspectos da violência obstétrica a luz do Projeto de Lei PL 7633/2014, que estabelece diretrizes aos direito da mulher durante a gestação, pré-parto e puerpério, bem como o tratamento legal dada ao tema por países latino americanos: Venezuela e Argentina. |
| Abstract: | The present work aims to direct a study about the violence obstetrics and its forms of manifestation as aspects that call into question the fundamental rights of pregnant women. To do so, the journey will be addressed by which childbirth was institutionalized, that is, leaving the family environment for hospital institution and the removal of the pregnant woman as the protagonist of the birth, which was responsible for the increase of vulnerability and damage to the fundamental rights of woman. This time, the offense to the dignity of the human person will be exposed, caused by institutional violence, as well as the need to greater protection of the rights of the personality, since it appears as an extension to concreteness of the principle of human dignity, in addition to analyzing the reform of childbirth from the conception of reproductive and sexual rights as rights humans. In addition, the study will be directed to the analysis of aspects of violence obstetrics in the light of Bill PL 7633/2014, which establishes guidelines for the rights of women during pregnancy, pre-delivery and puerperium, as well as legal treatment given to the theme by Latin American countries: Venezuela and Argentina |
