Abstract

The scope of the work is to discuss civil liability and its aspects, specificities and applications, with a focus on medical error resulting from aesthetic plastic surgeries. At first, it will be analyzed from the perspective of contemporary society and the search for perfection and ideals of beauty from plastic surgeries, presenting reasons for the great demand for surgical-aesthetic interventions. Then, the study of the general notions of civil liability, its classifications, elements, and obligations of means and result. subsequently, a study is carried out on the doctor's civil liability, with the investigation of what medical error is, what are its duties and rights, the exclusions of responsibility and its relationship with the consumer protection code. At the end, the civil liability of the aesthetic surgeon is specifically examined, with the analysis of decisions of the national courts, focusing on the discussion regarding the obligation of the plastic surgeon to be of means or result
