| metadata.dc.description.resumo: | O presente trabalho objetiva analisar a aplicação de medidas executivas atípicas, sob a égide dos princípios e garantias fundamentais, tuteladas pela Constituição Federal de 1988. Estas medidas estão encontram fundamento legal no artigo 139, IV do Código de Processo Civil, em que permite a aplicação de medidas indutivas, coercitivas, mandamentais, sub-rogatórias e atípicas para que o cumprimento da ordem judicial logre êxito. Por conseguinte, fato é que a inteligência trazida pelo artigo 139, IV, com a vigência do Código de Processo Civil de 2015, ainda esbarra sua aplicação em direitos e garantias fundamentais, como direito à liberdade de locomoção, bem como à proteção da dignidade humana. Portanto, o presente trabalho será abordado alguns limites que poderão ser impostos diante da aplicação |
| Abstract: | The present work aims to analyze the application of atypical executive measures, under the aegis of fundamental principles and guarantees, protected by the Federal Constitution of 1988. These measures are legally based in article 139, IV of the Civil Procedure Code, which allows the application of inductive, coercive, mandatory, subrogatory and atypical measures so that the fulfillment of the court order is successful. Therefore, the fact is that the intelligence brought by article 139, IV, with the validity of the Civil Procedure Code of 2015, still faces its application in fundamental rights and guarantees, such as the right to freedom of movement, as well as the protection of human dignity . Therefore, the present work will address some limits that may be imposed on the application |
