O interesse da vítima nas ações penais públicas, face à aplicação do enunciado criminal n.º 99 do FONAJE

Abstract

This monograph aims to analyze the interest of the victim in the process criminal law, especially in public criminal actions for crimes of lesser potential offensive, that is, of the Special Criminal Courts where justice operates restorative. In this sense, a priori, a presentation of the objectives and principles of the Special Criminal Courts, and a posteriori, a brief resumption of the victim's history in the criminal process to understand the reflexes historical figures of the victim in criminal proceedings. That said, there will be a analysis of the legitimacy and, consequently, of the interest of the Public Ministry in the public penal actions, as well as the spotlight that the Criminal Enunciation n.º 99, of the National Forum of Special Courts, gave the victim determined in these actions. In addition, the legal nature of this statement and the conflict of rights will be discussed. interest in the public actions of both the Public Ministry and the victim determined. Thus, it is intended to reach the conclusion of the possibility or not of application of the said statement, as well as the need to protect the interest of the victim determined in public criminal actions
