Title: A ética rizomática no Estado democrático de direito e o princípio da supremacia do interesse público

metadata.dc.description.resumo: O presente trabalho busca entender como a ética pode se aproximar da interpretação no neoconstitucionalismo para implementar o princípio da supremacia de interesse público e atualizar o Direito Adminstrativo tornando-o aproximado da Constituição. Foi aética a atuação do Estado pelas vias da supremacia do interesse público desde o liberalismo até o Estado democrático de Direito. A trilogia Estado, Constituição, e gestão pública se fez presente no Estado moderno como perspectiva de gerar o modelo razoável que fosse capaz de racionalmente afastar os interesses privados da esfera pública. Todavia, a intenção do Estado restou desfocada e sem ética, pois enquanto entidade abstrata o Estado é manejado imediatamente pelos administradores públicos que lhes concretizam os atos. Então o Estado pelas vias do interesse público afastou a ética e privilegiou mediatamente seus administradores públicos. O recuo histórico efetivado neste trabalho demonstrou que desde o fenômeno da Revolução Francesa o discurso do Estado de afastar o interesse privado pelas vias do interesse público foi paradoxal, pois agiu por intermédio de seus gestores e canalizou esforços para os interesses privados de quem maneja o poder. Neste aspecto, as Constituições assim como o princípio da supremacia de interesse público, foram elementos de racionalidade focada à burguesia. O aspectos racionais do Estado liberal, assim como os elementos sociais do Estado de bem estar e as nuances do neoliberalismo demonstram quão destorcida a forma com a qual a supremacia do interesse público foi canalizada à vontade privada, esvaziada da ética ou utilizando-a de forma utilitária. No Estado democrático de direito o neoconstitucionalismo questiona a supremacia de interesse público e a forma aética do Estado anular o cidadão. Ao invés da estrita legalidade administrativa a Constituição é interpretada por princípios mitigando a verticalidade, tentando corrigir aquela distorção. Sem ética, essa ação se torna nova falácia, pois representa novo giro focando institucionalmente interesses privados, uma vez que a interpretação aberta pode fluir subjetivamente para focar a pessoa e novamente o interesse privado. Para dar suporte a essa relação complexa, a ética rizomática se adere ao fenômeno na perspectiva de interpretar o princípio da supremacia de interesse público através dos princípios constitucionais e dos princípios da ética enquanto rizoma descrito por Gilles Deleuze. Assim o Direito faz um caminho interdisciplinar com a sociologia e filosofia observando os princípios: ruptura, conexão, multiplicidade, e cartografia.
Abstract: This study wants to understand how ethics can approach the interpretation in neoconstitutionalism to implement the principle of supremacy of public interest law and update the board administrator making it approximately the Constitution. It was unethical state action by way of the supremacy of public interest from liberalism to the democratic rule of law. The trilogy State Constitution, and public management has been present in the modern state as the prospect of generating reasonable model that was able to rationally exclude the private interests of the public sphere. However, the State's intention remains blurred and unethical, as an abstract entity as the state is handled immediately by public officials that they embody the acts. Then the State by way of public interest and ethics departed immediately focused their public administrators. The reduction effected in this historic work has shown that since the phenomenon of the French Revolution of the State speech to drive out the private interest by way of public interest was paradoxical because acted by his managers and channeled efforts to the private interests of those who wield power . In this respect the constitution and the principle of the supremacy of public interest, were elements of rationality focused on the bourgeoisie. The rational aspects of the liberal state, as well as elements of the state's social welfare and the nuances of neoliberalism show how distorted the way in which the supremacy of public interest was channeled to the private will, devoid of ethics or using it so utilitarian. In the democratic state neoconstitutionalism questions the supremacy of public interest and unethical way the state set aside the citizen. Instead of strict administrative law, the Constitution is interpreted by mitigating the upright principles, trying to correct that distortion. Without ethics, this action becomes a new fallacy, because it represents new twist institutionally focused private interests, since the interpretation open can flow to focus the person subjectively and again the private interest. To support this complex relationship, ethics rhizomatic clings to the phenomenon from the perspective of interpreting the principle of supremacy of public interest through the constitutional principles and the principles of ethics as described by Gilles Deleuze's rhizome. Thus the law makes an interdisciplinary way with the sociology and philosophy by observing the principles: rupture, connection, multiplicity, cartography.
