O dever fundamental da paternidade: reflexos da ausência da figura paterna na prática de atos infracionais

Abstract

The Statute of Children and Adolescents (Ecriad) has several protection mechanisms, especially when there is a violation of its rules. Parents have a fundamental duty to provide the necessary care for the growth and development of their children or wards, in all areas of life, within society. Several studies seek to analyze the commission of infractions by adolescents, however, the understanding of the reasons that lead them to commit those infractions are left aside. In this sense, this dissertation seeks to elaborate possible reasons that contribute to the entry of adolescents into the world of illicit acts, in this case, the absence of a father figure. Among many reasons, raising children is one of the most relevant since parents have direct responsibility for the education of children and adolescents. Over the course of this analysis, this work will seek to address the fundamental duties that are required in favor of adolescents, as well as the responsibilities of parents and tutors towards raising their pupils. Through a field study, it will be possible to conclude that father absence generates negative effects on the growth of children and adolescents. Paternal abandonment, in all its senses, generates the loss of direction of the abandoned child, causing several harmful consequences. Thus, the present study aims to research, including through fieldwork, and demonstrate the relevance of the legal duty of the parents and the paternal role in the development of children; as well as the psychological, social and legal consequences, that come as a result of their absence. The relevance of this work relates to the importance of the paternal role in the upbringing of infants, demonstrating the consequences of absence, such as disobedience; the lack of respect for authorities; the abandonment of studies and, ultimately, the practice of infractions
