dc.description.abstractIt seeks to understand the advances regarding the decriminalization of abortion obtained by the Brazilian feminist movement. It dissects the understanding of what reproductive law would be. It exposes the international legislation regarding such rights and shows the current Brazilian legislation on the subject. Then, it presents an excerpt of the historical evolution of the feminist movement in Brazil and explores the changes in the discourses that defend the decriminalization of abortion. Finally, it investigates the influence of the feminist movement in the course of expanding the list of illegalities excluded within the decisions of the Federal Supreme Court, analyzing the allegations of non-compliance with fundamental precepts nº 54/2012 and nº 442. analysis, it is concluded that Brazilian feminist activism was fundamental for the inclusion of exclusions in the Penal Code, in addition to the movement playing a crucial role in the processing of ADPF 442pt_BR
dc.description.resumoBusca compreender os avanços quanto à descriminalização do aborto obtidos pelo movimento feminista brasileiro. Disseca o entendimento acerca do que seria o direito reprodutivo. Expõe as legislações internacionais quanto à tais direitos e exibe a legislação brasileira atual sobre o tema. Em seguida, apresenta um recorte da evolução histórica do movimento feminista no Brasil e explora as mudanças nos discursos que defendem a descriminalização do aborto. Por fim, averigua a influência do movimento feminista no curso da ampliação do rol de excludentes de ilicitudes dentro das decisões do Supremo Tribunal Federal, analisando as arguições de descumprimento de preceito fundamental n.º 54/2012 e n.º 442. A partir da análise, conclui-se que o ativismo feminista brasileiro foi fundamental para que as excludentes fossem incluídas no Código Penal, além do movimento exercer papel crucial na tramitação da ADPF 442pt_BR
