| metadata.dc.description.resumo: | O trabalho pretende definir o que se deve entender por teoria da argumentação jurídica, com foco no papel da erística e sua relação com os conceitos de persuasão – a que a argumentação jurídica é tradicionalmente reduzida – e decisão. A metodologia utilizada consiste em uma arqueologia etimológica ou fenomenologia conceitual dos conceitos principais, a partir da Grécia antiga, onde nasceu a retórica. O texto sugere também que a sociedade contemporânea complexa pulveriza seus centros de decisão e amplia o caráter erístico do discurso jurídico. E procura os fundamentos antropológicos da decisão erística na impossibilidade de distinguir a mentira na linguagem humana e consequente comunicação. |
| Abstract: | The work intends to define what is to be understood by theory of legal argumentation, focusing on the role of eristics and its relationship with the concepts of persuasion – to which legal argumentation is traditionally reduced – and decision. The methodology used consists of an etymological archeology or conceptual phenomenology of the main concepts, from ancient Greece, where rhetoric was born. The text also suggests that the complex contemporary society pulverizes its decision centers and expands the eristic character of the legal discourse. And it looks for the anthropological foundations of the eristic decision in the impossibility of distinguishing the lie in human language and consequent communication. |
